Sustainable Development, Construction Contracts, Environmental Stewardship Principles.Abstract
The study examines the principles of environmental stewardship that can be incorporated into construction contract law. Construction projects often have significant environmental implications, making it crucial to minimize environmental impact at every stage. This research uses a normative approach to analyze the implementation of environmental principles in Indonesian construction contract law and the challenges associated with their application. The findings indicate that key environmental principles, such as sustainable development, prevention, precaution, intergenerational equity, and environmental impact control, can be integrated into construction contracts through clauses that require contractors to conduct environmental impact assessments, utilize environmentally friendly technologies, minimize natural resource consumption, and restore the environment upon project completion. By integrating these environmental principles into contractual frameworks, the construction sector can play a vital role in mitigating the environmental consequences of infrastructure development.
